Welcome to Himalayan Massif Trek Pvt. Ltd. These terms and conditions establish a legally binding agreement between Himalayan Massif Trek Pvt. Ltd. (referred to as "we," "us," or "our") and you (the "Client") for the services we provide. Please read these terms carefully before booking a trip with us. By booking a trip, you agree to be bound by these terms and conditions.
Booking and Payment
To confirm your payment, a deposit payment is required, which is 30% of the total booking price. This deposit helps us secure permits, logistics, and other necessary arrangements for your trek.
We understand that plans can change, and we strive to be as flexible as possible. However, to cover operational costs, a cancellation fee applies. This is a percentage of your total booking price and is deducted from the deposit payment.
Cancellation Fees
Cancel 30% days before departure: 5% of the trip cost
Cancel between 10 and 30 days before departure: 10% of the trip cost
Cancel within 10 days of departure: 20% of the trip cost
If you need to cancel, please notify us as early as possible to reduce charges.
Rescheduling
Unexpected circumstances can disrupt travel plans, even if you still want to do the trip. To support our clients, we have generously waived all rescheduling fees. You can postpone and reschedule your trip at no additional cost, as long as the new departure date falls within one year of your original booking.
Upgrades
If you wish to upgrade your accommodation, transportation, or any other services not mentioned in the Trip Includes section, please be aware that these upgrades will incur additional costs. We can assist in arranging these options for you based on your preferences and availability.
Helicopter Flights
Helicopter: If you need a helicopter evacuation or other means of transport due to altitude sickness or any other condition, your helicopter return flight ticket fare is non-refundable. However, if the flight operator cancels your flight due to bad weather in Lukla, Kathmandu, or any other reason, your flight ticket fare is 100% refundable.
Medical Evacuation: For trips that include a helicopter return, please note that conditional medical evacuation by helicopter is not a part of your return flight. Should you require a medical evacuation, an extra fee for heli transportation will apply. This is covered by the client themselves or their travel insurance provider.
Trip Cancellation/Modification/Postponement by Us
Himalayan Massif Trek Pvt. Ltd. closely monitors travel advisories issued by the Nepalese government and other relevant authorities. We will not knowingly operate trips that contradict such advisories. If civil unrest or any other significant event arises, we will inform clients as soon as we become aware of the situation.
A trip may be canceled if official travel advisories deem a destination unsafe or restrict access to a significant portion of the itinerary, making the primary objective of the trip unachievable. If the core objective can still be met by altering the itinerary, the trip will proceed with necessary adjustments rather than be canceled.
If no official travel ban is in place, but a client chooses to cancel based on a perceived threat or concern, it will be considered a voluntary cancellation, and standard cancellation policies will apply.
Clients who are not Nepalese nationals should refer to their respective government’s travel advice regarding Nepal and any transit countries. However, we will only be bound by Nepalese government advisories unless they align with other official recommendations.
Trips may also be canceled due to Force Majeure events that are beyond our control, including but not limited to war, civil unrest, industrial disputes, terrorist activity, natural disasters, pandemics, transport cancellations, severe weather, or unforeseen logistical issues.
Himalayan Massif Trek Pvt. Ltd. aims to maintain optimal group sizes for each trip, but we reserve the right to adjust group sizes if necessary. Similarly, listed guides, leaders, or support staff may change at any time without prior notice.
While we strive to adhere to published itineraries, adjustments may be necessary due to local conditions, weather, transportation delays, or unforeseen circumstances. Clients acknowledge that flexibility is essential in adventure travel, and itinerary changes may occur before or during the trip.
The Expedition Leader or Guide has full authority to modify the itinerary or activities if they determine that continuing with the planned schedule would pose a safety risk or if alternative arrangements would be more beneficial or enjoyable for the group.
If a participant’s behavior jeopardizes the safety, well-being, or enjoyment of the group, the leader has the right to remove them from the trip without a refund. Similarly, if a participant leaves the trip voluntarily at any stage, no refunds or compensation will be provided unless expressly approved by the company’s management.
Passport and Visas
A valid passport with at least six months of validity from your return date is required for all trips.
For Nepal, visas can be obtained upon arrival at Kathmandu Airport or from a Nepalese Consulate in your home country. The cost of the visa is the Client's responsibility.
For Bhutan and Tibet, we handle all necessary permits and visas. Required documents, including a passport scan, photograph, and proof of travel insurance, must be provided at the time of booking.
Travel Insurance
Travel insurance is mandatory for all Clients. Your policy must cover medical expenses, including high-altitude trekking, trip cancellations or delays, emergency evacuation (including helicopter rescue), and loss of baggage or personal belongings. We are not liable for any costs or expenses not covered by your insurance policy.
Health and Fitness
High-altitude trekking requires good physical and mental health. We strongly recommend consulting your doctor before booking a trip. Any medical conditions or disabilities must be disclosed at the time of booking.
Unforeseen Circumstances
We are not liable for itinerary changes due to unforeseen events such as natural disasters, adverse weather conditions, flight delays, cancellations, government restrictions, or political unrest. Any additional costs incurred due to these circumstances are the Client’s responsibility.
Risk and Responsibilities
Participation in our trips involves inherent risks, including personal injury, illness, or death. By booking a trip, you acknowledge and accept these risks. We are not liable for any injury, death, or loss of personal property that may occur during the trip.
Domestic Flight Delays and Cancellations
Flights in mountainous regions are often subject to weather-related delays or cancellations. If a chartered helicopter is required due to flight disruptions, the cost (approximately USD 550 per person, one way) will be the Client’s responsibility.
Changes to Trip and Pricing
We reserve the right to change trip prices at any time. If a trip is canceled or altered due to unforeseen events, we will offer an alternative trip of equal value or allow rescheduling.
Children and Minors
Participants under the age of 16 must be accompanied by a parent or legal guardian throughout the trip. The guardian is fully responsible for the child’s safety, behavior, and well-being. We do not assume responsibility for minors traveling without parental supervision. Additionally, certain high-altitude treks or strenuous routes may have age restrictions for safety reasons, which will be communicated at the time of booking.
Privacy and Publicity
We respect your privacy and do not share your personal information with third parties. By participating in the trip, you permit us to use photographs or videos taken during the trip for promotional purposes.
Complaints
If you have any complaints during the trip, please inform our staff immediately so we can address the issue promptly.
Applicable Law and Jurisdiction
The laws of Nepal govern these terms and conditions. Any disputes will be settled exclusively by the courts of Kathmandu, Nepal.
Modification of Terms
Only a Director of Himalayan Massif Trek Pvt. Ltd. has the authority to grant refunds, modify these terms, or waive any conditions. Any such amendments must be made in writing and will only be considered in exceptional circumstances.
Acceptance of Terms
By booking a trip with us, you confirm that you have read, understood, and agreed to these terms and conditions.
